Got a question about conveyancing?
Conveyancing on the Fleurieu believe education is an important role for a conveyancer and want to ensure you understand exactly what you are paying for when engaging a conveyancer.
We strongly believe in providing easy to understand explanations of the processes because, let’s face it, contracts can be cumbersome and difficult to understand, so it’s important to have someone you can trust to interpret and explain the contents.
The following are just some of the many questions we answer for clients regularly. If you have a question about conveyancing please give us a call on 8528 8940.
In South Australia conveyancers like Conveyancing on the Fleurieu are registered and authorised to prepare and lodge the necessary legal paperwork for your real estate transaction, changing the ownership from one party to another. During our contracts we carry out a range of searches on the property too to determine any constraints to the property transfer, and we can also explain more about the contents of your property sale or purchase contract. A conveyancer also determines what debts are outstanding on the property that can be dealt with in the transfer.
A conveyancer will research the debts that may be applied to the property prior to transfer. Among the outstanding bills that can be paid during the property transfer and settlement process are mortgages, council rates, water rates, stamp duty and other government charges such as the Emergency Services Levy.
Conveyancing on the Fleurieu is PEXA Certified which means we can use e-conveyancing (computer-based conveyancing rather than labour-intensive paperwork) to minimise the manual processes and paperwork involved with a property transaction. It saves not only time but also, potentially, money too. It has effectively eliminated the need for us to travel between the South Coast and Adelaide to lodge documents.
PEXA stands for Property Exchange Australia. It is one of the only a small number of platforms in the world that lets you lodge documents with the land registry, and pay settlement funds at the same time. The platform was created in partnership with representatives from the government, banking, legal and conveyancing communities with the aim of assisting e-conveyancing and helping to make transactions easier.
Conveyancing on the Fleurieu is PEXA Certified which means that, as well as our conveyancing qualifications we have also undertaken additional training and development programs through PEXA to ensure we are well-versed on the online platform to handle your e-conveyancing matter.
No. At Conveyancing on the Fleurieu we know that not everyone is a wiz when it comes to computers, and you won’t have to undertake any training or development with technology if that’s not your thing. We are happy to work with you in our Victor Harbor office, or even at your home, to assist you through the new online world of conveyancing. Challenges of transactions during the COVID-19 pandemic eliminating many options for manual transactions, so we’re here to help you through the process as painlessly as possible.
A Form 1 is a statutory discloser statement that must be provided by a vendor to a purchaser of a property or land. We at Conveyancing on the Fleurieu can help you or your real estate agents to complete this process as it is a prescribed requirement and a necessary part of any sale or purchase.
Although we all have to work with the same rules and regulations as conveyancers, there may be some differences in the way we do business. When engaging a conveyancer we would suggest you ask the following questions:
– Do you hold a membership with the AIC – Australian Institute of Conveyancers?
– What are the fees and charges for the services you provide?
– How long will the preparation of paperwork take?
– Are there government fees and charges that I will need to pay?
– How will you keep me up to date with the settlement process?
– What is the time-frame for settlement?
AIC stands for the Australian Institute of Conveyancers (you might notice the triangular logo at the bottom of our website) which indicates that Conveyancing on the Fleurieu is a current member. The AIC is the peak body representing Registered, Licensed and Certified Practising Conveyancers Australia-wide. It advocates and seeks to improve the services provided by conveyancers through regular sharing of information and working with government for legislative changes.
Stamp duty is charged by the State Government for transactions and documents, including the transfer of property ownership, leases and mortgages. In South Australia, stamp duty is handled by Revenue SA. As part of our conveyancing service we will include stamp duty charges within your settlement.
